MOD SHOP: MODIFIED IN MELBOURNE COMPETITION
FULL TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these terms and conditions. These terms and conditions constitute the entire agreement between each entrant and Promoter. Entry into the promotions is deemed to be acceptance of these terms and conditions and a contract is formed on these terms and conditions between the entrant and the Promoter.
- The promoter is Fender Music Australia Pty Ltd (ABN 34 613 081 191) of Unit 2, Building 5/85 O'Riordan St, Alexandria NSW 2015 (Promoter).
Prizes
3. Entrants may enter for the chance to win one of the following prizes:
(a) Grand Prize (4 prizes available). Each Grand Prize winner will receive:
(i) one ticket to the VIP Modified in Melbourne event;
(ii) for winners located outside of Victoria only, return economy flights from an Australian capital city, transfers and accommodation in Fitzroy, Melbourne; and
(iii) one customised Player II guitar package, valued at up to AUD $2,491.00;
(b) Ticket Prize (20 prizes available): Each Ticket Prize winner will receive one double pass to the VIP Modified in Melbourne event, together the Promotions.
4. The winners are only entitled to the prizes as outlined above and are not entitled to any additional prizes or cash reimbursement. Prizes are not transferable or exchangeable and cannot be redeemed for cash. No compensation is payable if the winner cannot receive any aspect of a prize for any reason.
5. Any Fender products included in the prizes (such as the Player II guitar) are subject to the Fender Warranty and consumer guarantee provisions of the Australian Consumer Law as outlined in clause 25.
Eligibility criteria

Entry is open to Australian residents over the age of 18, subject to the eligibility criteria in clauses 7 and 8.

To be eligible for the Ticket Prize, entrants must be residents of Victoria.
- All winners must be available to attend the Modified in Melbourne event on 8 May 2025 between 3.00 PM and 7.00 PM (specific attendance time for each winner will be scheduled once winners are confirmed) in Fitzroy, Melbourne. The event address will be provided to each winner once they receive the notification of their prize.
Entry Process
- To enter to win the Grand Prize, entrants must:
(a) Sign up to the Promoter’s mailing list and agree to its terms & conditions; and
(b) Tell us, in 25 words or less, “What is your favourite feature on the new Player II Modified series and why?”

To enter to win the Ticket Prize, entrants must sign up to the Promoter’s mailing list and agree to its terms & conditions.

The promotion commences at 6 a.m. AEDT on Wednesday 16 April 2025 and closes at 11:59 p.m. AEDT on Thursday 24 April 2025 (Promotion Period). The Promoter may extend the closing date of the Promotion Period in its sole discretion.

The Promoter must receive entries during the Promotion Period. All entries are deemed to be received at the time of receipt NOT at the time of sending by entrants. Late entries will not be eligible.

Each entrant may submit a maximum of one entry for the Grand Prize and one entry for the Ticket prize. Multiple entries for the same prize will not be accepted.

The entries must be submitted personally by the individual entrant. Any automated entries will be deemed invalid.

The Promoter reserves the right to verify the validity of entries. The Promoter may, in its sole discretion, disqualify any entries from and prohibit further participation in the Promotions by any person who tampers with or benefits from any tampering with the entry process or with the operation of the Promotions and reserves the right to disqualify any entry which is not submitted in accordance with these conditions of entry.
- The Promoter takes no responsibility for late, lost or misdirected entries. Incomplete, ineligible, or incomprehensible entries will be deemed invalid.
Winner Selection
- The Promoter will conduct the winner selection process at Unit 2, Building 5/85 O'Riordan St, Alexandria NSW 2015, within the first three business days after the end of the Promotion Period.
○ Grand prize winners will be drawn first, and ticket prizes second.
○ Grand prize winners will be chosen by a panel of 3 individuals from Fender Australia who will determine the most creative (i.e originality, humour, ingenuity) answer, under 25 words, to the Grand Prize question ““What is your favourite feature on the new Player II Modified series and why?”
○ Ticket Prize winners will be chosen at random using an excel random function

The winners will be notified either via email or phone by no later than 6 PM, 30th April 2025 AEST.

The winner must follow the instructions contained in the written notification to claim the prize.
- The Promoter reserves the right to require a winner to provide proof of age, identity, eligibility and any other relevant details to a standard satisfactory to the Promoter (in its sole discretion) before awarding any prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that entrant will be ineligible and deemed invalid.
General Terms

If, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the Promoter, then the entire prize will be forfeited by the winner, and cash will not be awarded in lieu of that element of the prize.

All additional costs not expressly stated herein but incurred in acceptance and use of the Grand Prize or Ticket Prize is the responsibility of the winner and will NOT be the responsibility of the Promoter. The winner will be responsible for paying for those costs not expressly set out herein and which may include (but is not limited to) any taxes, postage or other ancillary costs which are the sole expense and responsibility of the winner.

If, for any reason, there is any interference or disruption in the conduct or operation of the Promotion (including, but not limited to, due to power or technical failure, natural disasters, acts of God, computer viruses), the Promoter reserves the right to suspend, cancel, terminate, modify or recommence the Promotions subject to the approval of any applicable government authorities.

25. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the consumer guarantee provisions of the Australian Consumer Law.
- Subject to clause 25 and to the extent permitted by law, the Promoter excludes all liability for any costs, expenses, losses and damages suffered or incurred by the entrant, including any liability for personal injury or death or loss of business opportunity or liability due to negligence of the Promoter or its personnel, whether direct, indirect, special or consequential, arising in connection with these terms or the conduct of the Promotions, including (without limitation) the following:
(a) the participation in the Promotions by the entrant;
(b) the prize or any component of the prize;
(c) any tax liability incurred by the entrant; or
(d) any variation in the value of the prize.
- The Promoter is not responsible for any misdirected, late or incomprehensible entries in the Promotions.
- The Promoter is not responsible for any tax implications that may arise from winning a prize. Entrants should seek independent financial advice about such matters.
- These terms and conditions are governed by the laws of New South Wales, Australia. Entrants submit to the jurisdiction of the courts of that State.
