Terms and Conditions

• Entries are open to Australian residents only. However, the following persons are not permitted to enter the Promotion:
  • residents of the Australian Capital Territory;
  • any person involved in the conduct of the Promotion, including the drawing of the Prize; and
  • any director, officer or employee of the Promoter.
• The promotion commences at 10 am AEDT Saturday, 7th March 2026 and closes at 4 pm AEDT Sunday, 8th March 2026 ("Promotion Period").
• To enter, participants must complete the entry form accessible via the QR code on the Fender stand at the Sydney Guitar Show, Sydney Showgrounds, and agree to these terms and conditions. By entering the Promotion, participants agree that they will be signed up to the Promoter's mailing list, however they may unsubscribe at any time.
• The Promoter must receive responses during the Promotion Period. Only one entry per person is permitted. The individual entrant must submit entries; any automated entries will be invalid.
• The Promoter reserves the right to verify the validity of entries. The Promoter may, in its sole discretion, disqualify any entries from and prohibit further participation in this Promotion by any person who tampers with or benefits from any tampering with the entry process or with the operation of the Promotion and reserves the right to disqualify any entry which is not submitted in accordance with these conditions of entry.
• The Promoter takes no responsibility for late, lost or misdirected entries. Incomplete, illegible, or incomprehensible entries will be deemed invalid.
• The prize is a Fender Mod Shop Guitar ("Prize"), valued at AUD $4,127.00. The Prize is not transferable or exchangeable and cannot be redeemed for cash. No bonus prizes are awarded under this Promotion. See Mod Shop Terms and Conditions here.
• All costs and expenses associated with accepting the Prize, including but not limited to travel, accommodation, insurance and any other incidental costs, are the sole responsibility of the winner. The Promoter will not reimburse or compensate the winner for any such costs.
• The Promoter will conduct the winner selection process at Unit 2, Building 5/85 O'Riordan St, Alexandria NSW 2015, within the first three business days after the end of the Promotion Period. The winner will be selected from a random draw conducted by way of an electronic random number generator.
• The winner will be notified via email within 7 days of the date of the draw and asked to provide their delivery details. The Prize will be shipped to the winner's nominated address. If the winner cannot be contacted within 7 days of notification, or declines the Prize, the Promoter reserves the right to select an alternative winner.
• The winner's first name and state/territory of residence will be published on au.fender.com within 30 days of the draw date, in accordance with applicable state and territory trade promotion requirements.
• Estimated lead time on a Mod Shop order is 10-12 weeks from the date the order is placed.
• If, for any reason whatsoever, a winner does not take an element of the Prize at the time stipulated by the Promoter, then that element of the Prize will be forfeited by the winner, and cash will not be awarded in lieu of that element of the Prize.
• If the Prize is unclaimed after 3 months from the date on which the first winner was notified, the Promoter may conduct a redraw at the same location and in the same manner as the original draw, subject to any applicable regulatory approval. Details of the redraw will be published on au.fender.com.
• Prize winners acknowledge that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of the Prize. The Promoter accepts no liability for any tax obligations arising from acceptance of the Prize.
• The Promoter shall not be liable for any loss, including but not limited to direct, indirect or consequential loss or damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with participation in this competition or accepting or utilising a Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
• Nothing in these terms limits, excludes or modifies, or purports to limit, exclude or modify, the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties or guarantees under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the states and territories of Australia ("Non-Excludable Guarantees"). To the extent permitted by law, the Promoter's liability for breach of any Non-Excludable Guarantee is limited, at the Promoter's option, to replacing or repairing the Prize or supplying an equivalent prize.
• By entering this promotion, participants consent to the Promoter collecting, using, storing and disclosing their personal information for the purposes of conducting this promotion, including notifying winners and publishing winner details, in accordance with the Promoter's Privacy Policy and the Privacy Act 1988 (Cth). Personal information will not be used for any other purpose without the participant's consent. Where participants remain subscribed to the Promoter's mailing list, their personal information may also be collected, used, stored and disclosed for the purposes of promoting the Promoter's business, including to send email newsletters and marketing communications about products, services and events.
• If for any reason the Promotion is not capable of running as planned (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.
• If you have any queries about the conduct of this Promotion or the claiming of the Prize, please contact the Promoter at [email protected]. The Promoter will use its reasonable endeavours to respond to you within 10 business days from receipt of your query, and will seek to discuss a resolution to your complaint or dispute in good faith. If the Promoter has not resolved any dispute with you, you and the Promoter agree to resolve such dispute through binding arbitration in accordance with, and subject to, the Resolution Institute Arbitration Rules 2023, with the arbitrator nominated by the Chair of the Resolution Institute unless agreed otherwise.
• The laws of New South Wales govern this Promotion. Entrants submit to the jurisdiction of the courts of that State.
• The Promoter is Fender Music Australia (ABN 34 613 081 191) of Unit 2, Building 5/85 O'Riordan St, Alexandria NSW 2015.
